When an accident occurs, the respective insurance companies of the parties involved conduct an investigation. The State of California adheres to the so-called “Pure Comparative Fault” Rule, wherein it allows the injured party to recover even if it is 99% at fault but of course, the amount of recovery will be reduced by the degree of fault.
